Agreement to Terms

By using Familoop, you agree to these Terms of Service. If you do not agree, do not use the application.

Eligibility

You must be at least 18 years old to create a Familoop account. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

Parental Consent

Familoop is designed for use by families with children. By purchasing a subscription and adding a child's device to your family, you represent and warrant that:

Description of Service

Familoop provides a private, end-to-end encrypted messaging service for families. Messages are encrypted on your device and can only be read by members of your family. We cannot access your message content.

Subscription and Payment

Access to Familoop requires a paid subscription. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage your subscription through the App Store or Google Play Store.

Your purchase also serves as verifiable parental consent under the Children's Online Privacy Protection Act (COPPA).

We may terminate or suspend your account if you violate these Terms, including if we determine that you are not the parent or legal guardian of a child you have added to your family.

You may delete your account at any time through the Settings menu. Upon deletion, all account data is removed within 24 hours, except consent records which are retained for 7 years as required by law.

Disclaimer of Warranties

Familoop is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure. You acknowledge that no messaging service can guarantee absolute security or delivery of messages.

Limitation of Liability

To the maximum extent permitted by applicable law, Leyline Digital and its owner, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from:

Our total aggregate liability arising out of or in connection with these Terms or the service shall not exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid us any amounts, our maximum liability shall be fifty Australian dollars (AUD $50).

You agree to indemnify and hold harmless Leyline Digital and its owner, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

Dispute Resolution

Informal Resolution First: Before initiating any formal proceedings, you agree to contact us at legal@familoop.app and attempt to resolve the dispute informally for at least thirty (30) days.

Mediation: If the dispute cannot be resolved informally, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) in accordance with its mediation rules. The mediation shall take place in Sydney, Australia. The costs of mediation shall be shared equally.

Governing Law: These Terms are governed by the laws of New South Wales, Australia. Subject to the dispute resolution process above, the courts of New South Wales shall have non-exclusive jurisdiction.

Australian Consumer Law Notice

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification. Continued use after changes constitutes acceptance.
